CHAPTER NINE: TRANSITION, AMMENDMENTS AND DISSOLUTION.

51. Transition

Upon registration of CCM, The National Governing Council existing at the time of full registration shall perform the functions of NEC and the National Governing Council for a period of three years as it embarks on the establishment of other organs.

Notwithstanding any vacancy in the NEC, the party shall continue its functions.

52. Amendments to this Constitution

Any amendments to this Constitution shall be by a two-thirds majority of members present and voting at the National Mashinani Convention. Notice of intent to propose any amendments to the Constitution should be forwarded to the Office of the Secretary General at least three months before the National Governing Council. The NEC shall give at least one month’s notice for any Constitutional amendment. No amendment or change may be made to the Constitution except with the approval of the National Governing Council and by at least two thirds of the Votes cast by the members present or in proxy subject to the approval of the Registrar of the Political Parties.

 53. Dissolution

The Mashinani Convention may dissolve the organization by a two-thirds majority of members present and voting and transfer the assets and liabilities of the party in such a manner as determined by the National Governing Council but limited to granting the assets to one or more organizations in Kenya whose objectives conform to those of the Party. Such dissolution shall be subject to the approval of the Registrar of Political Parties.
